DTA is to provide vendors a designated space on Saturday, 21 June 2008 for the Midnight Sun Festival. The allocated vendors' space is on a first-come/first-served basis with the following priority: 2007participants shall be given a one (1) month advance application period commencing October 1, 2007 and ending October 31, 2007. Vendors agree to comply in full with this agreement. Failure to comply, or violation of any portion of this lease agreement may result, at the sole discretion of the Downtown Association of Fairbanks, in penalties up to, and including, vendor being removed from the event and/or banned from future participation in this, or any other DTA event. This agreement shall be enforced under the laws of the State of Alaska and is binding upon the parties, their successors, assigns and personal representatives.
IMPORTANT VENDOR REGULATIONS
Payment: Upon submittal of application, a DTA staff member will contact the vendor with booth details and discuss payment. A 50% non-refundable deposit will be required to guarantee any booth space. Full payment must be received by May 1, 2008 or the space will be reassigned. Payment can be made by credit card (Visa or Mastecard), but only in the full amount. Otherwise, we accept payment by check, money order, or cash (in person).There will be a $35.00 Non-Sufficient Funds charge for any check returned. No post dated checks will be accepted.
Sublease/Transfer: Vendors is not permitted to sub-lease or transfer their booth space(s).
Equipment: All vendors will need to bring his/her own tent, table and chairs. It is strictly forbidden for any vendor to attempt to secure tents or displays to the streets or sidewalks - this includes spiking pegs, nails or any other item. In the event of gusty weather, tents should be weighted at all corners to prevent accidental damage to any property.
Vendor's Move-In Time: 7 am -11 am, contingent on booth location. Upon receipt of full payment, each vendor will be provided with a scheduled move-in time slot based on their specific location. This is to avoid traffic congestion and blockages within the event area. All vehicles must be removed from event area by 11am. No traffic is permitted in the event area after 11am or prior to midnight.
Event Hours: Noon to Midnight on Saturday, June 21, 2008.The festival closes at midnight; however, you may start moving out after 11pm provided no vehicle is brought into the area.
Trash: Vendors must provide a minimum of two (2) trash receptacles lined with good quality plastic garbage bags. Vendors are responsible for emptying their trash cans into the dumpsters provided by DTA. In the event that nearest dumpster is full, leave bagged trash neatly beside. You must leave the grounds as you found them. Food vendors, see receptacle requirements under additional information.
Electrical Outlets: IT IS STRONGLY RECOMMENDED THAT YOU OBTAIN A GENERATOR FOR YOUR ELECTRICAL NEEDS, as NO GUARANTEE can be made that your electrical needs will be accommodated, and the available electrical outlets are EXTREMELY LIMITED. For those vendors who are granted permission to use one (1) 110 Volt outlet, the following rules apply:The electrical capacity of these outlets is a maximum of 1000 watts; NO EXCEPTIONS. To calculate your capacity, the formula to use is:Amps x Volts = Watts ...For example: A 20 amp appliance would overload the system because 20 amp x 110 volts = 2200 Watts. Vendors shall supply their own heavy duty outdoor extension cord that must be listed by a nationally recognized laboratory such as U.L. Each extension cord shall be plugged directly into an approved outlet to service one (1) appliance only. Extension cords must be in good condition without splices, deterioration or damage and must be 3-prong grounded. Do not use adapters that fit three wire plugs to two wire sockets. All extension cords must be at least 12 gauge wires. Due to multiple issues with electrical vendors overloading circuits, we are requiring that each vendor needing electricity list the electrical items they will be using in AMPS or maximum Wattage output. Violation of this agreement may result in fine and suspension from future DTA events.
Generators: Generators are allowed for use by vendors in booth areas provided a) the sound level created by the generator does not exceed 70dB b) vendor follows manufacturers safety regulations and the Fire Department's safety recommendations c) the generator does not cause air pollution problems d) is fully contained within the allocated booth space.
Family Focus: The Midnight Sun Festival is a family event. The Downtown Association reserves the unsuitable or objectionable. The restriction applies to noise, PA systems, persons, animals, birds, things, conduct, printed matter or anything of a character that might be objectionable to event management.
Event Delay or Cancellation: Downtown Association shall not be liable for any damage or expense incurred by vendors in the event the show is delayed, interrupted, or not held as scheduled. If, for any reason beyond the control of DTA the event is not held, DTA will retain as much of the amount paid by vendor as is necessary to defray expenses that have already been incurred.
Cancellation Policy:Please note that the 50% deposit is non-refundable.All cancellations received after May 1, 2008 will be deemed non-refundable.
Indemnity Clause: The Downtown Association will not be responsible for any injury, loss or damage that may occur to the vendor or the vendor’s employees or property from any cause whatsoever. The vendor, on renting booth space, expressly agrees to waive any and all claims against the Downtown Association, the City of Fairbanks and their respective liability insurance carriers, and to defend, indemnify and hold the same harmless against any and all loss, injury or damage arising out of, in whole or in part, participation in this event. This duty to defend and indemnify shall also include responsibility for all damages, costs and attorney fees. This obligation shall be continuing in nature and extend beyond the event.
Legality: Vendors shall comply with all applicable federal, state and local laws. Vendors must have a current business license and all relevant certificates/licenses or permits as required by the City of Fairbanks and the State of Alaska.
Liability Insurance:Vendors are required to carry liability insurance.
Gaming Permits: The use of a gaming permit at this event is strictly prohibited without prior written permission by DTA.
ADDITIONAL REGULATIONS FOR FOOD VENDORS
Food Permit:Vendors are responsible for obtaining a Temporary Food Service Permit from the State of Alaska Department of Environmental Conservation (DEC), 610 University Avenue, Fairbanks, AK 99709-3643, 907-451-2123. All vendors must call this number directly. Temporary Food Service Permit Applications must be received with payment no later than 4:30pm on Friday, 13 June 2008. DEC will inspect all food booths prior to the noon opening on the 21 June 2008. A blank copy of the Temporary Food Service permit will be sent to all food vendors upon receipt of their application.
Sanitation:Vendors are required to maintain sanitary conditions at all times, as required by DEC.
Trash: Each food vendor must provide a minimum of two (2) large trash receptacles lined with good quality plastic garbage bags. Vendors are responsible for emptying their trash cans into the dumpsters provided by DTA. Please, leave the grounds as you found them. Any booth that does not clean up in full and place trash in an appropriate location will be charged an additional $100.00 per booth space. Photos will be taken of any booth space that fails to clean up as proof by a DTA representative.
Grease: Any grease, cooking oil, or fat of any description used by the vendor must be removed from the area in a sealed container. Grease, cooking oil or fat of any description, cannot be emptied into drains, onto the ground, into the dumpsters or the river.Any violation of the above places the vendor in non compliance of this lease agreement and will result in being barred from any future participation of any Downtown Association event. Vendor will be responsible for any, and all costs associated with the appropriate clean-up resulting from such a violation. Any necessary clean up must meet City/State requirements and will be conducted and organized by DTA.
Glass: The use of glass beverage containers is discouraged.

This agreement shall be binding upon the parties, their successors, assigns and personal representatives. This agreement shall be enforced under the laws of the State of Alaska.
